Estimated number of hours Registered Nurses (RNs) are used annually at this location: 10,000

The estimated number of Registered Nurses needed over the 24-month contract period will depend on the number of shifts that need coverage. The estimated percentage of Registered Nurses for each shift is as follows:

Weekday – Monday through Friday Percentage
Day Shift – 7:30 a.m. to 4:00 p.m.   11%
Evening Shift – 3:30 p.m. to 12:00 am 26%
Night Shift – 11:30 p.m. to 8:00 a.m. 26%

Weekends – Saturday and Sunday Percentage
Day Shift – 7:30 a.m. to 4:00 p.m. 1%
Evening Shift – 3:30p.m. to 12:00 am 50%
Night Shift – 11:30 p.m. to 8:00 a.m. 50%

Holidays Percentage
Day Shift – 7:30 a.m. to 4:00 p.m.   0%
Evening Shift – 3:30 p.m. to 12:00 am. 20%
Night Shift – 11:30 p.m. to 8:00 a.m. 33%

New York State Office of Addiction Services and Supports (NYS OASAS) will select up to three (3) Successful Bidders from the qualified bid submissions received. The awards will be made to the Bidder(s) who provide(s) the lowest cost and upon approval of funding.

Pricing should be submitted for bill rate per hour, and overtime rate, and holiday rate using Attachment 18.

In the event of tied bids, NYS OASAS shall break the tie using the following order of precedence:

1.Bidder is a NYS Certified Minority, Women-Owned, Small Business Enterprise, or Service-Disabled Veteran-Owned Business.
2.Bidder with the greatest number of years of relevant experience.

Bid Submission requirements
A.Completed Attachment 18 – Request for Quote

Bidder Requirements

A. The Successful Bidder shall be responsible for providing nurses who can work on weekday day, evening, or night shifts; and/or weekend day, evening or night shifts; and/or holiday day, evening or night shifts. All nurses must be licensed and/or certified by the New York State Education Department.

B. The Successful Bidder shall inform their nurses that they are required to comply with the NYS OASAS and the Addiction Treatment Center’s (ATC) time and attendance policy (i.e., contact supervisor two (2) hours prior to start of shift for call-outs, limit unscheduled absences for unexpected serious personal and family circumstances, request desired leave in advance, remain flexible to work overtime and additional or different shifts, maintain and submit time records timely).

C. The Successful Bidder must have telephone coverage and be available to accept requests for services 24 hours per day, seven days per week. All services will be on an on-call basis. The NYS OASAS ATC Director(s) or designee(s) may contact the Successful Bidder when services are required.

D. The Successful Bidder shall provide a nurse within two (2) workdays on all requests for assignments in excess of two weeks. The Successful Bidder shall also provide backup personnel for any nurse that call in absent for their assigned shift. The Successful Bidder shall provide a replacement nurse within eight (8) hours for regular requests. Any day-of call-ins should be replaced with another nurse within two (2) hours.

E. If the Successful Bidder’s nurse reporting to work at an ATC is deficient in the performance of an assignment, the Successful Bidder may be reported to the Office of General Services (OGS) and the nurse may be rejected by NYS OASAS. If rejected, the Successful Bidder must provide a replacement nurse within one (1) workday of the nurse’s next scheduled shift.

F. All care shall be provided in accordance with Article 139 of the New York State Education Law. All ATC patient information shall be handled in accordance with Federal Confidentiality Regulations 42 CFR Part 2 and all other applicable State and Federal statutes and regulations.

G. The NYS OASAS is required to ensure that all its business partners protect confidential health information of the patients at its facilities as required by the Federal Health Insurance Portability and Accountability Act (HIPAA). Appendix E – Qualified Service Organization/Business Associate Agreement must be completed at the time an award is made to the Successful Bidder to comply with regulations for services involving the use or disclosure of Protected Health Information (PHI). If the Successful Bidder refuses to participate in a Business Associate Agreement, NYS OASAS is prohibited by law from contracting with the Successful Bidder (45 CFR § 164.504).

H. Travel expenses will not be reimbursed.

I. The Successful Bidders shall provide a nurse within eight (8) hours of notice.

J. The Successful Bidders may be assessed liquidated damages for each time that an employee is late or does not show for work (if not previously excused in writing). The liquidated damages shall be equal to twice the hourly rate to be paid and may be deducted for each hour or part thereof that the employee is late.

Background Check Requirements

I.A screening against the Staff Exclusion List (SEL) of the Justice Center will be conducted by NYS OASAS Human Resources Management. RNs or LPNs whose names are indicated on the SEL will be barred from employment.

J.A Criminal Background Check that includes State and Federal Criminal History Record Checks will be conducted by NYS OASAS Counsel’s Office. All convictions must be reported; conviction of a felony or misdemeanor, or any falsified or omitted information on the prospective appointee’s employment application may bar appointment or result in removal after appointment. Each case will be determined on its own merit, consistent with the applicable provisions of State and Federal laws, rules, and regulations. RNs and LPNs will be fingerprinted in order to obtain a record of their criminal history information. NYS OASAS will pay the fingerprinting fees (approximately $100).

K.A screening against the Statewide Central Register (SCR) of Child Abuse and Maltreatment will be conducted by NYS OASAS Human Resources Management. RNs and LPNs will be required to pay the fees for this screening (approximately $25). RNs and LPNs whose names are indicated on the SCR will be barred from appointment.

L.The Successful Bidder has the responsibility to ensure that any temporary employee utilized under this contract is not an illegal alien and that there is no violation of any immigration laws in his/her temporary employment by the State. The Successful Bidder will provide NYS OASAS with an I-9 for verification purposes.

M.NYS OASAS ATC Directors will check for citations against the RNs or LPNs with the New York State Education Department.

N.All other background check fees will be the responsibility of the Successful Bidder, and not billable to NYS OASAS.

NYS OASAS Addiction Treatment Centers Responsibilities
A.The ATCs will interview the Successful Bidders’ selection of RN(s) and LPN(s) prior to their initial shift at an ATC to determine his/her qualifications. The ATCs reserve the right to reject the RN or LPN if they determine that they are not qualified based on the job qualifications.

B.An ATC may cancel a request for services at its sole discretion, if a selected RN or LPN is deficient in the performance of an assignment. All deficiencies will be reported to the Office of General Services (OGS) by utilizing the Contract Performance Report provided by OGS.

C. The ATCs shall maintain the right to review the Successful Bidder’s selection process and/or RNs or LPNs’ resumes and licenses/registrations with the New York State Education Department.

D. The ATCs have the right to reduce the length of the work assignment and the Successful Bidder will be provided as much notice as is reasonably possible. A minimum of 24 hours’ notice will be given.

E. The ATCs reserve the right to stipulate the length of time that RN LPN personnel will be required for extended periods if necessary.

F. NYS OASAS shall not be liable for any expenses incurred by the Successful Bidder as a consequence of any traffic infraction or parking violations attributable to RN(s) or LPN(s) of the Successful Bidder.

G. NYS OASAS reserves the right to terminate the Successful Bidder’s provision of services any time that it determines that the Successful Bidder is unable or incapable of performing the work to NYS OASAS’ satisfaction or that the RN(s) or LPN(s) performing the services do not have the required license/registration issued by the New York State Department of Education.

H. NYS OASAS reserves the right to reject and bar from the facility, for cause, any LPN(s) or RN(s) hired by the Successful Bidder.
